Customer represents and warrants that all data in any environments used in connection with the Service (including for testing purposes) does not include any Personal Data, Sensitive Personal Information, Protected Health Information, or other regulated or sensitive data.

The Service, including its original content, features, and functionality, is owned by Treebeard Corporation and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any content, data, or materials you submit to the Service ("Your Content"). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store Your Content solely for the purpose of providing the Service to you.
Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
The Service may integrate with third-party services (such as Jira, Slack, and others). Your use of these integrations is subject to the terms and policies of those third-party services. We are not responsible for the practices or content of third-party services.
The Service includes features and functionalities supported by AI technologies. As a part of core functionality, the Service includes capturing and transmitting data (such as screenshots) from configured web properties to third party AI models provided by OpenAI and Anthropic. By using Cofactor, you agree to this and agree to indemnify, defend, and hold harmless Treebeard Corporation and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Upon termination, we may delete your account and all associated data in accordance with our data retention policies.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Treebeard Corporation regarding the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
